UK gay marriage challenge goes to European Court

A challenge against the UK’s bans on gay marriage and straight civil partnerships will be filed at the European Court of Human Rights this week.

The Equal Love campaign, led by gay rights activist Peter Tatchell, seeks to open both institutions up to all couples, regardless of sexual orientation.

The UK legalised civil partnerships for gay couples in 2006, but campaigners say they are not good enough.

Four gay and four straight couples tried to register for ceremonies they were not entitled to in the run-up to Christmas.

Their letters of rejection will be used to form the case. The couples are taking the case to a European court to avoid paying the UK government legal fees if they lose.

The court application will be filed on Wednesday morning and Green MP Caroline Lucas will be the keynote speaker at a launch event in Westminster.

Human rights lawyer Professor Robert Wintemute, who is the couples’ legal advisor, said he was confident that they would win.

He said: “Banning same-sex marriage and different-sex civil partnerships violates Articles 8, 12 and 14 of the European Convention on Human Rights.

“It’s discriminatory and obnoxious, like having separate drinking fountains or beaches for different racial groups, even though the water is the same. The only function of the twin bans is to mark lesbian and gay people as socially and legally inferior to heterosexual people.”

He added: “I am confident that we have a good chance of persuading the European Court of Human Rights that the UK’s system of segregating couples into two ‘separate but equal’ legal institutions violates the European Convention.

“I predict that same-sex couples will be granted access to marriage in the UK and that this will be because the UK government will eventually accept that it cannot defend the current discriminatory system.”

Mr Tatchell said: “Outlawing black or Jewish people from getting married would provoke uproar. The prohibition on gay marriages should provoke similar outrage. Arbitrarily excluding heterosexual couples from civil partnerships is equally reprehensible.

“The bans on same-sex civil marriages and opposite-sex civil partnerships are a form of sexual apartheid – one law for gay couples and another law for heterosexual partners. Two wrongs don’t make a right. In a democratic society, we should all be equal before the law.”

In 2010, Nikolai Alekseev won in the European Court of Human Rights on LGBT human rights violations in Russia. The court ruled that, by banning three Moscow Prides in 2006, 2007 and 2008, Russia breached three articles of the European Convention. The case marked the first ever international defeat of the Russian Government on the issue of LGBT rights.

In an attempt to force Nikolai to withdraw the case, Russian authorities kidnapped him on September 16, 2009, as he was boarding a Swiss Air flight. They stole his cell phone and sent fake text messages to his friends and the press asserting that he was defecting from Russia and withdrawing his case. Two days later, Alekseev was freed and the lies were exposed.

Last year’s kidnapping wasn’t the first time Alekseev had been harassed for standing up for LGBT rights. He and his colleagues of the Russian LGBT Rights Project have faced brutality, violent arrests by riot police, kidnappings and other atrocities. Against great odds and strong opposition throughout their country, they have fearlessly and relentlessly pursued equality for all LGBT Russians.

Last week, the brutal murder of David Kato and near-deportation of Brenda Namigadde — two Ugandan activists working to defeat a brutal anti-LGBT bill in their country that would allow multiple ‘offenders’ to be put to death — were a horrific reminder of the stakes that LGBT people can face for organizing for greater rights. We can’t stand aside and let these atrocities happen.

Dear Lacy,

I remember the first time I introduced my 3-year-old son Jack to Sesame Street. From Big Bird, Bert, and Ernie to songs about ABC’s and 123’s, Sesame Street quickly became one of his favorite shows. We still watch together, and he always learns something new.

But now, right-wing Republicans in Congress want to take Big Bird and his friends away from my son with slash-and-burn budget cuts, just to pay for more tax cuts for millionaires.

Thing is? PBS makes up less than .0001% of the federal budget. ENOUGH ALREADY.

I’m lucky that my son goes to a wonderful pre-school. But not all kids in our country are so lucky. That’s why it is so important that public TV programs like Sesame Street and Curious George introduce concepts like math and science in fun ways that benefit ALL kids.

Darrell Issa, David Dreier, Kevin McCarthy and the entire CA Republican congressional delegation have lined up to cut programs like Sesame Street out of our lives. PBS is a public resource and one that enriches our community and our children’s education.

Will you join me and Jack and tell Issa and the rest of the CA Republican delegation to keep their hands off of our children’s education?

I’m not going to stand for eliminating good education for my kid while Republicans dole out tax cuts to millionaires. I’ve watched PBS for over 40 years and I’m not going to let it go now.

Without PBS, there’s no more NOVA to spark Jack’s interest in science. There’s no more Sesame Street to introduce Jack to a world that shares, cares and learns. And there’s no more NewsHour with Jim Lehrer, or Frontline: unbiased journalism that isn’t bought and paid for by big corporations.

I love California and our country and I love my son.  I want Jack to grow up in an America that cares about its kids, not about tax cuts for millionaires.

Join me to demand that the California Republican congressional delegation says yes to PBS and no to budget cuts that hurt our children.

But far from backing off, Republicans are doubling down. They released a new version of their budget Friday that not only zeroes out federal funding for NPR and PBS going forward, but even claws back funding for this year that’s already been promised.1

A group of House Democrats is fighting back with a “Dear Colleague” letter, and they’re trying to get as many representatives as possible to sign on by the time they deliver it to the House leadership tomorrow. Can you call Rep. Bass now and ask her to add her name?

Tell her why NPR and PBS are so important to you, personally, and then ask her to sign the “Dear Colleague” letter being circulated by Rep. Earl Blumenauer’s office protesting the cuts.
